Content generated by our AI systems based on your inputs ("AI-Generated Content") is owned by you once delivered. However, MoFlo retains all rights to the underlying AI technology and algorithms.
While our AI systems are designed to produce high-quality content, you are responsible for reviewing and approving all AI-Generated Content before publication or use. MoFlo is not responsible for any consequences resulting from your use of AI-Generated Content.
MoFlo does not guarantee that AI-Generated Content will be entirely unique or free from similarities to content created for other customers. Our systems are trained on large datasets and may produce similar outputs for similar inputs.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOFLO, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.
UNDER NO CIRCUMSTANCES WILL MOFLO'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT PAID, IF ANY, BY YOU TO MOFLO FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
You agree to defend, indemnify, and hold harmless MoFlo, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.
MoFlo reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website and updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.
You may terminate your account at any time by following the instructions on our website or by contacting our support team.
MoFlo may terminate or suspend your access to all or part of the Services, without notice, for conduct that MoFlo believes violates these Terms or is harmful to other users of the Services, MoFlo, or third parties, or for any other reason.
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
For Professional and Enterprise plans, MoFlo guarantees 99.9% uptime for our Services. Details of our SLA, including definitions of downtime and compensation for failure to meet guaranteed uptime, are available at moflo.ai/sla.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Las Vegas, Nevada, using the English language in accordance with the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one or more commercial arbitrators with substantial experience in resolving intellectual property and commercial contract disputes.
These Terms constitute the entire agreement between you and MoFlo regarding our Services and supersede any prior agreements between you and MoFlo relating to the Services.
The failure of MoFlo to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
You may not assign or transfer these Terms, by operation of law or otherwise, without MoFlo's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. MoFlo may freely assign or transfer these Terms without restriction.
